credit card refunds - 120 day rule?
One of our guests (paid £300 by Barclaycard), is being told by Barclaycard that their chargeback policy means they can only return the money if it was within 120 days, or if the wedding was within 120 days-this would also count. (We ordered our list on 28.04.08 and I believe they first contacted Barclaycard at teh beginning of August when the news broke.)
Sounds like a load of nonsense to me. As the as far as I know the consumer act doesn't mention a timeframe?
Anyone had similar problems?

Details of the 120 day rule as it states below:
The issuer must wait until the specified merchandise delivery date has passed
before charging back the transaction. For example, if the delivery date is
1 June, the issuer cannot submit the chargeback before 1 June. The issuer may
charge back the transaction before the specified merchandise delivery date if it
is established that the card acceptor will not provide the goods because it is no
longer doing business. If there is no specified delivery date, the issuer must
wait 30 calendar days after the transaction date before charging back, and be
within 120 days from the Central Site Business Date of the original presented
transaction.
The issuer may charge back the transaction before the specified merchandise
delivery date if it is established that the card acceptor will not provide the
goods because it is no longer in business.
For a Debit MasterCard purchase with cash back transaction, an issuer can
submit this chargeback only for the purchase amount, or a portion thereof.
The issuer must submit the First Chargeback/1442 message with a Function
Code of 453 (Partial Amount). An issuer must not submit a chargeback for the
cash back amount, or any portion thereof, using this reason code.
Additional chargeback requirements and limitations apply to World MasterCard
Card T&E transactions. Refer to section 1.6.1.1 of this guide for more
information.

If your guests go back to Barclaycard to say your expected delivery date was 21st July 08 (12 weeks after 28.04 - see wrapit t&c's) and at this point the delivery failed, they can claim back. The 120 rule only applies where there was no specified delivey date...

I had the same problem with Natwest Visa but I argued the case and said that I didn't know I was not going to get the gifts until they went into administration - A full refund was then offered ?

Does anyone have an address for Visa Debit Card Lloyds Bank TSB that I can write to (or Phone) for a payment made of less that £100 ... my High Street branch said I should write to KPMG but I am sure it is for the bank to reclaim the money from Wrapit's HSBC account isnt it ???? My 120 days are nearly up so I need to get a move on !

See the bank chargeback spreadsheet page - there are both numbers and addresses you can use.
I've had guests successfully claim for amounts under and over £100.00 from Lloyds..

A guest of mine is getting rejected by Sainsburys Visa for her £150 gift as they have said over 120 days have passed since she bought the gift. I have told her many times that it should be 120 days from date of delivery date and that she should speak to someone in dispute. Has anyone else had any luck claiming back from Sainsburys - thinking any success stories may help her with her case.
We've just heard that a guest of ours is being refunded by Sainsburys Visa. Your guests just have to be persistent with them. Make sure you supply all the relevant information that confirms your transaction and when the goods were meant to be delivered etc.
Has anyone with a gift list open for over a year had any problems with MBNA Mastercard? They're claiming that they must go by the transaction date and not the date the goods were ordered and they'll only consider chargebacks within 540 days from the transaction date. I've never heard this before and have had no problems with other Mastercard companies.
Has anyone else heard about this or have any advice to help us fight our case?
